Perancangan harta mengikut undang-undang Islam menggunakan konsep hibah

Abstract

Hibah is one of the important instruments in property planning according to Islamic law. It is the giving of a gift whether it is given to one who is in need or to someone that you loved without thinking of something in return. This instrument is encouraged in Islam, if it is been execute correctly and accordingly to the needs of Syarak, it can avoid the disagreement between the heirs. Through hibah, it can also help close relatives that need the help and support. There is a thought that by doing hibah then you are offended the law of faraid. These thought is incorrect because these instrument is actually been focused and had its place in Islamic Law. However, this instrument is not well known compare to other property or estate planning. Now, Muslim in this country thought that faraid and will is the best way to manage and planning inherit property and so hibah is getting less attention. That is why this research is being done to find out more about hibah, the advantage and disadvantages and also the effort that can be done to make hibah a more well known estate planning among the community. The research involves interviewing officers from Amanah Raya Berhad, As-Salihin Trustee Berhad and Amalan Harmoni Sdn. Bhd. To analyze the data that being collected, the writer uses the descriptive method which is the method to explain more detail about the result of the analysis. At the end of the study, the writer can explain why hibah is the best way in property or estate planning compare to others.
