Abstract
Social amenity projects (PAMS) can be defined as facilities are facilities cunstructed at certain of places or land for the local community and the surrounding area can be utiled on sharing basis. Land is divided into 5 main groups, namely land ownership, mine land, reserve land, forest reserve land and government land. Owned land refers to land that is legally registered. Government land, on the other hand, covers all lands under the authority of the Federal Government or the State Government excluding reserve land, owned land and forest reserve land. The Facility of the Social Amenities Project (PAMS) provides a thousand benefits to the local community to improve the living economy and facilitate their daily affairs. However, the construction of PAMS on proprietary land will cause various disputes between the government and the landlord in turn affecting the management of PAMS. Therefore, this study was conducted to identify weaknesses in PAMS guidelines and procedures on land owned in Bagan Datuk district, using semi-structured interview methods involving Perak KPLB Director, Yang DiPertua Majlis Perbandaran Teluk Intan and Chief Assistant District Officer, Kuala Kangsar District and Land Office. Besides, the structured interview method involving representatives of the Village Community Management Committee (JPKK), landlords and local residents was also conducted. In addition, the purpose of this study is also to resolve disputes on ownership / absolute rights and maintenance of PAMS using data from Perak State Government departments such as Perak Land and Minerals Office (PTG), Perak State Secretary's Office (SUK) and Religious Council Islam and Customs of Perak (MAIP). As a result of the study, weaknesses in the implementation and construction guidelines of PAMS were identified as the source of problems with the determination of absolute ownership and maintenance of the construction. This study is believed to provide a guideline for the implementation of PAMS that can be applied by each state or district administration and be a solution to disputes that occurs.
