Abstract

Waqf land development issues, often noticed by the Muslim community at the moment. Among the issues often associated hinder the development of waqf land in Johor is the issue of registration of title. Issues that occur in the donated land title registration in the state of Johor is seen regarding the registration process takes a long time to register to MAINJ or al mutawalli as sole trustee to the donated land. If the referred law of the land in the country, the National Land Code 1965 (Act 56) provides that no person or certain bodies entitled on land that has not been registered (Section 340). The registration of title to become the most important elements in ensuring the development of waqf land is on the right track. Without registration, instead of the existing waqf land ownership MAINJ under the provisions of the Land Code. Because of that, a study conducted focuses on the process of registration of title to land ownership practiced by MAINJ and Johor Land Administration and the issues and problems arising from donated land that has not been registered and the effects that will occur. The methodology used in this study the issues and problems is through qualitative analysis with semi-structured interviews conducted with officials and staff of the MAINJ and the Land Office. In summary the research conducted has been able to identify the real issues and problems that occur in the process of registration of title to land ownership that occurred in the two agencies whether on policy and implementation level, which in turn causes a waqf land title can not be executed. Propose further improvement of policy and implementation level to the authorities to ensure that the donated land in Johor has been granted on behalf of MAINJ.
