Abstract

The meaning of the Word of Allah in Surah al-Anbiya' 21:35 of "Every soul must taste death, and We try you by evil and by good by way of probation; and to Us you shall be brought back". Every human life will certainly die. That's the end of human life on earth as was destined by God. When the corpse of the deceased buried, next heirs responsibility is to divide the assets of the deceased to the heirs entitled, subject to the conditions that i) settlement of the funeral arrangements, ii) explaining the debts of the deceased and iii) fulfill his will, if any. Prompt division of inheritance is needed because when a person dies, the property will automatically transfer the rights belong to the deceased's heirs. This study was designed to examine understanding of the established agencies in dealing with inheritance claims in Malaysia and administrator’s understanding of the order of appointment issued by the Small Estate Distribution Section, JKPTG examined whether the parties involved in the management of the estate is understand or vice versa. Primary data obtained through interviews with the Small Estates Officer, legal practitioners and the public. Secondary data were obtained through reading text books, seminar papers, previous studies, acts, enactments, circulars and guidelines involved in the distribution of the property. These data have been analyzed in qualitative and descriptive. Findings and proposed solutions in this study can be used to make an amendments to laws related to and enhance the system of estate management in Malaysia.
