Abstract

As one of the land disposal methods, Temporary Occupation License (TOL) provides opportunity to the society to increase their income. Furthermore, the application process took much shorter time to be approved compared to title application. The society had considered TOL as one of precondition in land alienating which could enable them to obtain title for a land. Where as, in the point of view of the State Authority (SA), TOL is a temporary method to disposing land and it could contribute income to state. The issue that arises with this method is that the society have to come to face with some difficulty when they are burdened with the high annual fee and the limitation of ownership to their land. It looks like that conflict had arisen with the societies hope and the income contribution from the land to SA. Equilibrium point has to be sort out for both, the society and SA, for they have their own importance in their own ways in contributing to the state economy. This research is being carried out with focus on the effort taken by the society and income contribution from TOL, in order to achieve its goal to make TOL as an effective land disposal method. The effectiveness is in term of income contribution to both the society, which is the holders of TOL, and also SA. Due to this, Pekan district in Pahang had been chosen as the research sample area. Three objectives had been layout for this research. The descriptive analysis had been carried out in order to attain these objectives. The research finding not only focuses from the land administrative perspective but also other related aspects including the aspiration and views of TOL the holders. From the findings, recommendations had been made. The most basic recommendation is an internal information updating process in term of TOL records and more accurate marking system by the Land Administrator. Other recommendations includes to establish a special area for TOL, revision on the term and rates to be charged to the TOL holders and a clear policy on title issuance for the TOL holders who developed their land. When the recommendation is followed, it’s hoped that more harmonious and stronger relationship between the TOL holder and SA could arise, which in the end could contribute more income to the state.
