Abstract
The stratum development of the underground reserve land which was first approved by the Selangor State Government on 17th December 2009. The approvals were given for the purposed of the 85 units of parking lots specifically for Empire Shopping Gallery, Subang Jaya, which were located below road reserves. Subsequently, in 2015, One City Development Sdn. Bhd. has also submitted the same application. Both of these applications were approved and gave good returns to the Selangor State Government. Based on JKPTG’s Circular No. 1 Year 2008, the allocation procedure for the stratum lease of the underground reserves refers to subsection 63 (1) [subsection 92E (1) & 92E (4)] [subsection 92F (1)]. Referring to Section 63 KTN, any lease granted under this section shall be given via Form 4E. As the Form 4E (Leasehold Lease Form) was given for Stratum Lease application by the Couture Homes Company and One City Development Sdn. Bhd., a problem occurs in determining the lease rate that may be imposed at that time whether it is necessary to follow the current market valuation of the land or otherwise because of the lease application may only be leased for a period not exceeding 21 years and its use is limited to parking spaces only. Hence, this study is aimed at proposing a lease payment rate for stratum development application that can be used as reference to interested parties in the future. In order to achieve the objective of the research, it outlines two (2) objectives. The first objective is to identify the method for determining the rate of lease payments for development of underground reserves. While the second objective outlined to study the determination of stratum lease payments for underground development. The area of study was concentrated in Petaling District. The methodology of the study was using qualitative method through semi structural interview approach. Respondents involved in this study consist of 11 officers in government departments such as JKPTG, PTG Selangor, PDT Petaling and JPPH Selangor. Analysis of studies is based on literature review as well as the opinions and views of interviewed by respondents proved the method of determining the lease payments of stratum for the development of underground reserve land was successfully obtained. Therefore, among the proposals that can be implemented to empower the determination of stratum lease payments in future is to create a task force group to study the stratum rate in details and to improve the stratum lease application process. As a conclusion, the determination of the underground stratum lease has been successfully assessed and identified through this study and the proposed proposals are expected to provide added value to the better development of stratum as well as to encourage alternative sources to accommodate limited land supplies.
