Abstract

The rapid growth in the state of Johor generally, and Johor Bahru specifically, had contributed to the increasing of land development either state land or private land. The development includes housing estates, commercial areas, new township and agricultural land. This rapid development had contributed to many sorts of problems such as environmental problems and breach of condition. In the title registration document, either Land Office Title or Registrar Title, there is a paragraph that states the condition of land or land use which has to be adhere to by the land owner. If breach of condition is being done by the land owner, legal action could be taken upon them. The land owner could apply for change of condition to the District Land Office and they will be charged with administration fees, premiums and quit rent based on the new condition they applied if approved. If the development made not according to the condition by the land owner without any approved change of condition, the District Land Office could take actions through law enforcement based on the National Land Code 1965 and Johor State Rule, either through applying for change the land use condition, remedying the breach or the land being taken back by the state government. The work process and procedure of law enforcement or applying for change of condition is clearly stated in the Land Office Work Procedure Manual, but there are some setback which had made files that are being investigated either could not be close or takes a longer time to be completed. Hence, research is being carried out to identify and to give ideas to make law enforcement efficient to be taken by the Land Office such as consistent and informative enforcement, reviewing of work procedure and process and cleaning of work backlog. This is to ensure that the state government will receive income from fees charged for the change of conditions by land owner such as administration fees, premiums and quit rent and to ensure the adhering of laws by the land owner themselves.
