Abstract

Examining the reality of current life in Malaysia, diat's punishment has room to be implemented in the law today. Road accidents are not an unfamiliar thing in Malaysia's pluralistic society and the diat punishment system is seen to provide justice to victims also help in lightening the burden of offenders. The concept of diat and basic property for diat are discussed a lot by past and contemporary scholars and differ greatly views on the concept of diat and basic property for diat payment. Therefore, this study aims to explore the history of diat legislation from the time before the arrival of Islam, and its transformations after the arrival of Islam as well as analyze the diat basic of properties payments. This study also aims to examine the economy and the current reality of community life in Malaysia to see the suitableness of diat value setting rates that are relevant to be implemented. The methodology used is a library research method based on primary sources such as the Quran and hadis and secondary sources taken from the collection of documentation such as journals, articles, books, theses, internet sources, papers, newspapers, and others to find out current issues that arise and the views of contemporary Islamic scholars as well as the opinions or views of past scholars which are very important to get an interpretation of the primary sources related to the implementation of this diat system. The results of this study found that the implementation of the diat system in current legislation in Malaysia is still relevant from the point of view with the harmonization between the diat legal system and civil law, in fact, the diat basic of property is studied also can be implemented by evaluating the current economic situation in Malaysia.
