Abstract

Whipping is among the punishments imposed for prescribed offenses. In terms of its implementation, syariah whipping has already been implemented in each state based on the syariah law of the state. This article describes the historical background of syariah whipping in Islamic law in the State of Johor as well as analyzing the provisions of syariah whipping law in the state of Johor. This study is qualitative in nature. Data were obtained through library research methods and interviews with syarie judges of the state of Johor as well as references to cases that have been decided by the relevant courts. The results of the study found that whipping in Islam has its own concept and philosophy. In the context of the state of Johor, whipping has already been implemented based on the historical background and legal provisions available in the state.
