Abstract

The intention of the landowner in the matter of land partition is very important. Landowners who want to divide their land to family members, for instance, should not be treated like land development wants to be carried out. However, based on current practice, there is no difference in procedure based on the intentions of the landowner. As a result, there is a potential loophole that can be manipulated especially by landowners who want to develop his land. This study was conducted to examine the management procedure of land partition application to be feasible for land management and management facilitation. The objective of the study is to identify the problems in the implementation of land partition procedures practiced in the Land and District Offices and to study the improvement of land partition application management procedures. Semi-structured interviews were conducted with the Director or representative of the Land Development Unit, Land Management Division, District and Land Office of Petaling, Hulu Langat, Sepang and Sabak Bernam who are responsible for managing land partition applications in their respective districts. The management procedure is divided into four stages namely pre-consultation, receive, process and approval of applications. The result shows that the main problem is the same application management procedure is implemented to manage land partition application even though the method of termination of title is different. The existing management procedure is only suitable to be implemented for land partition applications with the consent of all landowners. Based on these problems, there is a lacuna of actions that need to be implemented but not formally documented. Several improvements are proposed by providing application management procedures according to the type of termination method, namely applications without the consent of the joint owner, applications for land categories and agricultural conditions of less than two -fifths hectares and applications accompanied by Court orders. It is hoped that this study can benefit land administration in improving efficient governance so that appropriate procedures can be translated, as well as to landowners to increase their knowledge and understanding of their right to submit land partition application and the process involved before any approval is given.
